Terms of Service

Critical clauses for commissioning luxury furniture through Faber.

Important Notice

By using Faber, you agree to these terms. Please read carefully, especially the sections on payment escrow, IP ownership, and artisan independence. These terms protect both clients and makers in the luxury commissioning process.

The Spec Sync Disclaimer

AI-Generated Technical Briefs

The Faber AI Design Flow generates a technical specification document (the "Spec Sync") that includes dimensional guidelines, material recommendations, joinery methods, and structural considerations. This document serves as a creative brief and starting point for collaboration between you and your chosen artisan.

Artisan Verification Requirement

The AI provides design guidance—not engineering guarantees. Final dimensions, structural integrity, material feasibility, and craftsmanship techniques are verified by the master artisan during the shop-drawing phase. Artisans have the authority and responsibility to modify specifications to ensure the piece is safe, durable, and buildable while maintaining your design intent.

Client Approval of Changes

Any significant deviations from the original Spec Sync must be communicated to you for approval before production begins. You retain final say on aesthetic decisions, but defer to the artisan's expertise on structural and material matters.

Deposit & Release: Stripe Escrow Flow

50/50 Payment Structure

All Faber commissions follow a 50/50 payment structure: (1) 50% Upfront Deposit: Paid directly to the artisan upon proposal acceptance to cover materials, tooling, and initial labor. (2) 50% Held in Escrow: Retained in a Stripe-managed escrow account until you confirm delivery and satisfaction.

Client Obligation to Confirm Delivery

Upon delivery of the commissioned piece, you are required to inspect the work and verify it meets the agreed specifications within 7 business days. If the piece is satisfactory, you must click "Confirm Delivery & Release Funds" in your Client Dashboard to release the escrowed funds to the artisan.

Dispute Resolution

If the delivered piece does not meet the agreed specifications, you may file a dispute through the Faber Resolution Team before confirming delivery. Faber will mediate between you and the artisan to determine a fair resolution, which may include corrections, partial refunds, or (in rare cases) full refunds with return of the piece.

Non-Confirmation Policy

If you fail to confirm delivery or file a dispute within 30 days of the artisan marking the project as "Delivered," the escrowed funds will be automatically released to the artisan. This policy protects artisans from indefinite payment holds.

Intellectual Property Ownership

Your Designs Remain Yours

You retain full ownership of (1) Your unique design prompts and instructions submitted to the AI, (2) The AI-generated Spec Sync documents and renderings, (3) The final commissioned furniture piece. Faber claims no intellectual property rights to your custom designs.

No AI Training on Private Data

Faber does not use your private design data, prompts, or commissioned pieces to train our AI models. Your creative work is confidential and will never be used for training purposes without your explicit, written consent. Our AI is trained exclusively on public domain archives, historical design catalogs, and licensed datasets.

Artisan Pattern Rights

While you own the design and the finished piece, artisans retain the right to use techniques, joinery methods, and general craftsmanship knowledge developed during your commission for future projects. Artisans may not replicate your exact design for other clients without your permission.

Commercial Reproduction Rights

You have the right to reproduce, sell, or modify any piece you commission through Faber for personal or commercial use. However, if you wish to commission multiple identical pieces from different makers for large-scale reproduction (e.g., for a hotel or restaurant), we ask that you work with our Licensing Team to ensure artisans are fairly compensated.

Maker Independence & Vetting

Independent Contractor Status

All artisans on the Faber platform are independent contractors, not employees of Faber. They operate their own workshops, set their own rates (subject to our $15,000+ minimum), and maintain creative and technical authority over their work.

Faber Artisan Advisory Board

Every maker is vetted by the Faber Artisan Advisory Board—a panel of master craftspeople, designers, and materials experts. We require: (1) Portfolio review demonstrating mastery of craft, (2) References from past clients, (3) Proof of workshop insurance and business licenses, (4) Ethical material sourcing certification, (5) In some cases, physical inspection of workshop facilities.

Ongoing Quality Monitoring

Faber monitors artisan performance through client reviews, dispute rates, and on-time delivery metrics. Makers who consistently fail to meet quality standards, miss deadlines, or violate ethical sourcing policies may be removed from the platform.

Platform Liability Limitations

Because artisans are independent contractors, Faber is not liable for defects, delays, or disputes arising from the commission process. However, we provide escrow protection, dispute mediation, and—in cases of proven negligence or fraud—may offer partial refunds or credits toward future commissions. Your primary recourse is through the escrow system and dispute resolution process.

Additional Terms

Platform Fee: Faber charges a 10% platform fee on all commissions, transparently included in proposal prices.

Cancellation Policy: Commissions may be cancelled before the artisan begins work for a full refund minus a 5% processing fee. Once work begins, cancellations are subject to artisan approval and may incur material and labor costs.

Shipping & Insurance: Shipping costs and insurance are the client's responsibility unless otherwise specified in the proposal. Artisans will coordinate white-glove delivery options for fragile or large pieces.

Warranty: Artisans provide a 1-year limited warranty against defects in materials and craftsmanship. Normal wear, misuse, or environmental damage is not covered.

Governing Law: These terms are governed by the laws of the State of New York. Disputes are resolved through binding arbitration in accordance with the American Arbitration Association.
